1. Acceptance of terms

By creating an account or using Booked.so (“Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. About the service

Booked.so is a multi-tenant social media management and calendar scheduling platform operated by xAscend Inc. The Service allows you to:

Connect your social media accounts via OAuth
Compose, schedule, and publish content to connected platforms
View analytics on published content
Manage calendar bookings and appointments
Receive AI-assisted content recommendations

3. Account responsibilities

Provide accurate registration information
Maintain the security of your account credentials
Be at least 18 years old (or have legal guardian consent)
Comply with the terms of each social platform you connect
Use the Service only for lawful purposes

You are responsible for all activity under your account.

4. Acceptable use

You may NOT use Booked.so to:

Publish content that violates third-party rights (copyright, trademark, privacy)
Distribute spam, harassment, hate speech, or illegal content
Misrepresent your identity or affiliation
Attempt to gain unauthorized access to the Service or other accounts
Reverse-engineer, scrape, or exploit the Service
Resell or sublicense the Service without written authorization

Violations may result in immediate suspension or termination.

5. Connected platforms

When you connect a social platform via OAuth, you authorize Booked.so to act on your behalf within the permissions you grant. You remain responsible for:

Maintaining your platform accounts in good standing
Complying with each platform's terms of service
Content quality and accuracy

We are not liable for actions taken by social platforms (account suspensions, API changes, content removal).

6. Pricing and billing

Where applicable, you agree to pay all fees according to your selected plan. Fees are non-refundable except as required by law. We may change pricing with 30 days' notice.

7. Termination

You may terminate your account at any time via account settings or by emailing dev@booked.so.

We may suspend or terminate your account if you violate these terms, with reasonable notice except for serious violations.

8. Intellectual property

You retain ownership of content you upload. By using the Service, you grant Booked.so a limited license to store, process, and transmit your content to the platforms you have connected.

The Booked.so platform, brand, and code are owned by xAscend Inc.

9. Disclaimers

The Service is provided “as is” without warranties of any kind. We do not guarantee uninterrupted service, content delivery to all platforms, or platform-side outcomes.

10. Limitation of liability

To the maximum extent permitted by law, xAscend Inc's total liability for any claim arising from your use of the Service is limited to the fees you paid in the 12 months preceding the claim, or USD 100, whichever is greater.

We are not liable for indirect, consequential, or punitive damages.

11. Indemnification

You agree to indemnify xAscend Inc against claims arising from your content or your violation of these terms.

12. Governing law

These terms are governed by the laws of Delaware, USA. Disputes are resolved via binding arbitration except for injunctive relief.

13. Changes

We may update these terms with 30 days' notice. Continued use after changes constitutes acceptance.
